Kim Smaczniak

Kim is a seasoned litigator, rigorous advocate, and creative problem solver. She offers clients a deep knowledge of energy regulatory matters before the Federal Energy Regulatory Commission (FERC) and expertise in advocating for their interests before FERC and the courts. 

Kim previously served as Special Counsel at the Office of General Counsel of FERC from 2021-2025, where she specialized in ensuring successful issuance and legal defense of high priority reforms to planning and siting electric transmission infrastructure, generator interconnection procedures, and RTO/ISO market rules. She oversaw FERC’s federal litigation docket, advising on the most complex and high-risk cases.  

Prior to her role at FERC, Kim ran the Clean Energy Program at Earthjustice, a public interest law firm that represents NGOs and companies in RTO/ISO processes, before regulators, and in the courts. Kim oversaw a team of attorneys and directed litigation strategy across more than a dozen states, before state utility commissions and state courts, and at the federal level, before the Department of Energy, FERC, and the federal courts.

Kim’s career began as an environmental lawyer, serving as lead negotiator on climate mitigation with the State Department; as Counsel in the Senate Environment and Public Works Committee; and as a trial attorney with the Environment and Natural Resource Division Environmental Defense Section.  

Kim earned her Juris Doctor from Harvard Law School, her Master of Public Policy from the John F. Kennedy School of Government, and her bachelor’s degree from Carnegie Mellon University.
